THE BENEFITS OF DOCUMENTING HUNGARIAN HERITAGE
IN THE 2010 US CENSUS
At the fourth Hungarian Americans Together Conference, held in Cleveland, Ohio on September 17-18, 2009, the participants discussed the issue of the Census and its implication for the Hungarian-American community. They prepared recommendations to inform the community’s leadership for addressing the importance of answering question 9 correctly.
Once a citizen records their identity information, the Census Bureau is bound by law to register it in the final results of the 2010 Census. These results are important, because policymakers both in the legislative and executive branch of the government pay attention to the composition of the population in the USA. If the government is aware of the number of Hungarian-Americans in the US, they will hopefully take a more proactive role in addressing the concerns of this community.
When answering question 9, therefore, it is very beneficial for citizens with Hungarian heritage to state that they are Hungarian in the extra space provided. To make the information about race even more useful to the Hungarian-American community, citizens can designate their identity with even more specificity, namely as Hungarian-Romanian, Hungarian-Serbian, Hungarian-Slovakian, Hungarian-Ukrainian, or Hungarian-Austrian, if they come from Transylvania, Vojvodina, Slovakia, Transcarpathia, or Burgenland respectively.

NOW IS THE TIME TO TAKE CARE OF ALL YOUR PASSPORT AND REGISTRATION MATTERS, WHILE YOU CAN STILL DO THEM WITHOUT TRAVELING TO LOS ANGELES, THAT IS BEFORE JUNE 2009.
The Hungarian passport gained a lot of popularity in the past two decades, even here, in the USAbecause a Hungarian passport means EU citizenship. It gives us the same rights as EU citizens have. The USA as well as Hungary recognizes double citizenship.
In order to have this success story become a reality it was not only Hungary, the country, that had to satisfy certain challenges, but also the passport system. The USA and the EU, leading the international community pushed for passports containing biometric data. This happened because of the September 11, 2001 terror attacks and in order to prevent illegal immigration. Nowadays the modern passports can be read by machines, and the personal data, the photo, and in certain states, the fingerprints are all stored on a chip built into the document.
The European Parliament’s plenary session unanimously accepted an amendment to the EU rules about biometric (containing photo and fingerprint) passports on January 14, 2009. According to the change children less than 12 years of age do not have to be fingerprinted. The biometric passport will be introduced simultaneously in the EU, in Iceland, in Norway and in Switzerland on June 29, 2009.
There will be numerous changes in the passport applications initiated at a consulate. We will advise citizens about the developments. Fingerprinting will require the personal appearance, (e.g. for residents of WA, OR, and ID at the Consulate General in Los Angeles), for every person involved, meaning all family members over 12 years. The new kind of passports will require serious technical infrastructure, therefore the passport fees will increase by approximately 40%.
In the long run certainly we will find a way to cooperate with other European countries, so our clients should not have to travel great distances. Until then, Seattleites will have to travel to the Consulate General in Los Angeles. No doubt the rules for acquiring a passport are definitely strict.
All Hungarian citizens have the duty to register changes in their family status (marriage, divorce), yet many only do that when they are applying for a passport. In the past year all whose passport has expired even by one day, and does not have another valid document certifying his/her Hungarian citizenship (Hungarian I.D. card, citizenship certificate) has to ask for verification of his/her citizenship. This means longer wait for the passport and additional fees.
Therefore, and because of the imminent changes, the Consulate in Seattle and the Consulate General in Los Angeles repeatedly would like to draw attention to the fact that

Important News on notarization: From now on because of changes in Hungarian laws, translations can only be notarized by the Consulate General in Los Angeles. We can still take care of the translation itself, but the notarization will come from them. Copies and signatures will continue to be notarized by me. Please call me first with any question you may have because that will speed up the work. Los Angeles has to take care of 19 states, so it may take longer for them to get to a certain case.
The Los Angeles Consulate General started a webpage (www.mfa.gov.hu/kulkepviselet/los_angeles/hu) three months ago. You can read about their activities there. In addition Ambassador Balazs Bokor, Consul General sends out Information about the activities of the Consulate General in Los Angeles. If you are interested, please send him your e-mail and he will put you on his list. E-mail: bbokor@kum.hu In this there are always explanatory notices about available services regarding administration. These are also summarized in this column.
In the last communication there were notices about repatriation. Every Hungarian citizen has the right to return home. There are two ways to prove Hungarian citizenship either with a valid Hungarian passport, or a Certificate of Citizenship, which is valid for one year only. Dual/multiple citizenship is accepted by both countries: you may have both USA and Hungarian citizenship simultaneously. If you only have a foreign passport, you may still repatriate with a long-stay (over 90 days) visa documents. In possession of any of the three above-mentioned, after your return to Hungary, you have to go to your respective City Hall and ask for a Hungarian personal I.D. This is necessary in order to get your belongings into the country custom-free, and for health insurance, pension and elections. Of course, you may at any time go home to visit with your American passport, without a visa. If you have lived for more than 12 months in a foreign country (in our case the USA; EU member countries do not count as foreign countries) and the 12-month period can be proven by things such as utility bills paid by you, then personal possessions can be brought back with you to Hungary customs-free if they have been in your possession for more than 6 months and you will be using them for the same purpose in Hungary as you had been using them in the USA for at least 6 months. Tobacco and alcohol do not fit into this category. The above information is only informational!

The American Hungarian Scouts called on all Hungarians around the world to organize the Fire of Hungarian Solidarity on August 20th, the day of St. Stephen. At the time of the 1933 Jamboree in Gödöllő, Hungary, the first such event took place. On that day our scouts lit campfires all over Hungary and in the territories Hungary lost to the surrounding countries in the Treaty of Trianon: at the agreed time the fires were lit in Gödöllö, in the mountains of the Hargita, the Tátra, the Mecsek, in Szabadka, in the Bakony; everywhere where Hungarian scouts lived. In August of 2003, the Hungarian Scouts in Exterris renewed this Fire of Hungarian Solidarity, which is now a permanent fixture of their annual work plan. This year, everywhere according to their own time zone, fires were lit around the world at 9 pm starting with the International Dateline New Zeeland-Australia, accompanying the 20th of August to finally come to rest in Honolulu (Hawaii). So, when the first fireworks went up in Budapest during the St. Stephen’s Day celebration, the Fire of Hungarian Solidarity had been on its way already for 11-12 hours and it still had the same amount of time to go. pension pension A MAGÁN-NYUGDÍJPÉNZTÁRI TAGSÁGI JOGVISZONY FENNTARTÁSÁRÓL SZÓLÓ NYILATKOZAT FELVÉTELE
Az Országgyűlés 2010. december 13-ai ülésnapján elfogadta a Nyugdíjreform és Adósságcsökkentő Alapról, és a szabad nyugdíjpénztár-választás lebonyolításával összefüggő egyes törvénymódosításokról szóló 2010. évi CLIV. törvényt, amely a mai napon hatályba lépett. A törvény módosította a magánnyugdíjról és a magánnyugdíj pénztárakról szóló 1997. évi LXXXII. törvény (a továbbiakban: Mpt.) egyes rendelkezéseit is. Kihirdetésre került a társadalombiztosítási nyugdíjrendszerbe történő átlépésről szóló kormányrendelet is (a továbbiakban: R.).
Az Mpt. 24. § (10) és 123. § (6) bekezdése szerint a magán-nyugdíjpénztári tagnak a magánnyugdíjrendszerben fennálló tagsági jogviszonya fenntartásának szándékáról 2011. január 31. napjáig – személyazonosságának ellenőrzése céljából – személyesen kell nyilatkoznia bármely nyugdíjbiztosítási igazgatóságnál vagy a Nyugdíjfolyósító Igazgatóságnál, illetve az Országos Nyugdíjbiztosítási Főigazgatóságnál (a továbbiakban: ONYF). Nyilatkozattétel hiányában a társadalombiztosítási nyugellátásban nem részesülő magán-nyugdíjpénztári tag tagsági jogviszonya a törvény erejénél fogva 2011. március 1. napjával megszűnik.
Az Mpt. 24. § (10) bekezdése szerint a nyilatkozattételre rendelkezésre álló időtartam alatt tartósan külföldön foglalkoztatott, tartós külföldi szolgálatot teljesítő vagy külföldi tanulmányokat folytató magán-nyugdíjpénztári tag nyilatkozatát személyesen a Magyar Köztársaság külképviseletén is megteheti. Ezt a lehetőséget a R. 1. § (1) bekezdése is tartalmazza. A Külképviseleten elkérhető nyomtatványt 3 eredeti példányban kell kitölteni, ebből egyet az ügyfél visszakap, kettő pedig felterjesztésre kerül. A (internetről le nem tölthető, de Képviseletünkön rendelkezésre álló) nyilatkozat nyomtatványon a konzuli tisztviselő aláírásával és a külképviselet bélyegzőjével igazolja, hogy a magán-nyugdíjpénztári tag előtte személyesen megjelent, és a nyilatkozattételhez előírt adatok igazolásához szükséges okmányokat bemutatta.
A nyilatkozattételhez előírt adatok igazolásához a következők bemutatása szükséges:
A személyazonosság igazolására: magyar személyazonosító igazolvány, vagy útlevél, vagy vezetői engedély;
Lakcímet igazoló okirat;
A tartós külföldi tartózkodás jogcímének igazolására: vízum vagy zöldkártya;
Amennyiben Önnél van, úgy a Társadalombiztosítási Azonosító Jelet tartalmazó hatósági bizonyítvány vagy Európai Egészségbiztosítási Kártya.
Külön aláírás hitelesítésre (konzuli tanúsítvány kiállítására) nincs szükség.
A nyilatkozat megtételénél a magán-nyugdíjpénztári tagnak valószínűsítenie kell, hogy a jogszabályban felsorolt jogcímeknek megfelelő okból tartózkodik külföldön (Mpt. 18. § szerint: "...A nyilatkozattételre rendelkezésre álló időtartam alatt tartósan külföldön foglalkoztatott, tartós külföldi szolgálatot teljesítő vagy külföldi tanulmányokat folytató magán-nyugdíjpénztári tag..."). Amennyiben a magán-nyugdíjpénztári tag nem a fenti jogcímek egyikének megfelelő okból tartózkodik külföldön (hanem pl. hosszabb látogatás, gyógykezelés céljából vagy családtag), akkor csak Magyarországon van nyilatkozattételi lehetősége. Fentiek tudomásulvételéről nyilatkozatot kell aláírni!
A tartósan külföldön tartózkodó magán-nyugdíjpénztári tag akkor is igazolási kérelmet terjeszthet elő, ha nyilatkozatát 2011. január 31-éig rajta kívül álló okból nem tudta megtenni. Ennek határideje az akadály megszűnésétől számított nyolc nap, de legkésőbb 2011. február 28-a. Az igazolási kérelemhez a fentieknek megfelelően ebben az esetben is három eredeti példányban kell mellékelni az ügyfél nyilatkozatát, aláírással és kézbesítési címmel ellátva.
Az ONYF tájékoztatása szerint az eljárással kapcsolatos információkat tartalmazó közlemény a jogszabályok kihirdetését követően elérhető lesz az ONYF honlapján (www.onyf.hu).
